CHOCOLATE DELIGHT - CHOCOLATE WORKSHOPS
Definitions
Seller, Us, Our, We, – means, Chocolate Delight.
Buyer, you, your – means, you, the person who is booking the product/services from us even if you are booking on someone else’s behalf.
Course – means The Chocolate Course.
GENERAL BOOKING TERMS
A contract is formed when the Seller receives a booking from the buyer and that is confirmed by us to you.
You agree to arrive on time, be dressed appropriately and to enter into the spirit of the class. You should not have consumed excessive alcohol prior to the class. You agree to be responsible for informing everyone in your group as to the location and time of the course which will last around 2.5 hours.
Any variations on the terms and conditions can only be permitted if expressed in writing by the seller
All equipment necessary to carry out the chocolate course will be provided by us.
Payment & Prices
All prices for individual bookings on our public courses are inclusive of VAT.
Our prices may vary from time to time and we reserve the right to alter the prices when necessary.
Dress Code
We reserve the right to refuse entry to the venue or class should the dress code not be adhered to. No refund will be given in any circumstance.
Venue
We will provide suitable venues for all our public courses to be held. These premises will be made clear to you at the time of booking. There will be toilets available and the premises will comply with all Health and safety requirements as well as current fire regulations.
We reserve the right to change the venue and will give as much notice as possible.
Chocolate Delight Ltd can not be held responsible for any cost incurred in respect of any travel or accommodation in the event of a change of venue.
In the unlikely event of a change of venue within 28 days of the date of the course, if you were unable to attend we will offer you an alternative date.
Change of Date
In the event that you are unable to attend your chosen date, provided you give more than 21 days notification we will do our best to find another suitable date.
If no suitable date can be found, cancellation fees if applicable shall apply. If you give less than 21 days notification you will be charged a cancellation fee accordingly.
Should you fail to notify us and or not show on the date of the event, then you forfeit your tickets and no monies or alternate dates will be offered in any circumstances.
Cancellation
Cancellations must be made in writing by you; we cannot accept telephone calls to cancel a booking.
If the booking is cancelled by you, 28 –14 days before the event we will refund 50% of the balance payment (if full payment has been made at that time).
If the booking is cancelled by you, 14-7 days before the event, we will refund 10% of the total booking price.
If the booking is cancelled by you, 7 days or less before the event we are unable to refund any monies.
We reserve the right to cancel any course. We will contact you to offer an alternative date or time and should a suitable alternative not be found we will offer a full refund.
In the unlikely event of a course being cancelled Chocolate Delight Ltd can not be held responsible for any cost incurred in respect of any travel or accommodation.
General Food Allergies
It is possible that the chocolate used on the courses may contain traces of nuts. If you or any of your group has a nut or other allergy which is brought on by chocolate, it is your responsibility to ensure that, that person/s is aware of this statement. We will not be liable for any reactions to nuts or other allergies whilst attending our courses.
Insurance
We provide Public Liability Insurance of up to £2million for all events that we do. A copy is available to you upon request.
General
The Contract is between the Seller and the Hirer as principals and may not be assigned by the Hirer without the express written consent of the Seller. These Conditions form the whole agreement between the Seller and the Hirer and shall not be removed or varied in any way. The Seller is in default of any of its obligations hereunder, it shall not be liable where such default is due to any act of God, war, strike, lockout, industrial action, fire, flood, drought, tempest or other event beyond the reasonable control of the Seller. In such circumstances, the Seller shall give notice to the Hirer where possible, and be released from performance of its obligations hereunder to the extent the event of supervening impossibility prevents or restricts the Seller’s performance. These Conditions are subject to English Law and the Hirer consents to the exclusive jurisdiction of the English courts in all matters regarding the Services. It is not the intention of the parties to confer any rights contained in The Contracts (Rights of Third Parties) Act 1999 on any third parties referred to herein, and any such rights, which may otherwise be implied, are hereby excluded.
Validity
Each gift voucher is valid for a maximum of 12 months unless otherwise stated. A voucher will be deemed to be invalid if it is out of date (the validity date is clearly stated on the gift voucher). If the customer or recipient is unable to utilise the voucher before the expiry date, then upon the customer contacting Chocolate Delight Ltd prior to the expiry date on the voucher and paying an administration fee of £20 (if the activity has increased in price they will also need to pay the difference in price and subject to product availability) the company shall issue a voucher extension cover letter granting an additional 6 months validity. Vouchers can only be extended if they are still inside their expiry date.
